LEGAL TERMS AND CONDITIONS OF BIKE CARRIER DISCOUNT FOR PARTICIPANTS OF ABR COMPETITION 2024
1. OBJECT.
In order to promote its sales and reward users, the company CRUZBER SAU (hereinafter "CRUZBER"), with CIF (VAT NR): ES-A-14018311 and with registered office at Las Salinas Industrial Estate II, Plot 12, CP 14960 Rute (Spain), telephone: 0034 957 538 354 and general email address export@cruzber.com, promotes "CRUZ Bike Carriers Discount", which will be governed by the following legal bases (the "Legal Terms and Conditions")
2. CAMPAIGN PERIOD.
The period during which you can participate in the promotion and raffle will begin on February December 26th1st, 20243 at 00:00 (CEST) and will end on February May 3129tsth, 2024 at 23:59 (CEST).
3. TERRITORIAL SCOPE.
This Promotion will be valid in Europe.
4. PARTICIPATION REQUIREMENTS.
All participants must be over 18 years of age and the have taken part in ABR competition (Andalucía Bike Race) 2024. CRUZBER employees are excluded from participating in this Campaign.
5. PRIZE
A raffle will be held among all participants who have correctly complied with the raffle’s rules and have registered the purchase in our Registration form.
A total of (1) Prize are awarded, drawn among all those who acquire and register any of our CRUZ ski racks during the dates mentioned for the raffle (from February 26th, 2024 at 00:00 (CEST) until May 31st, 2024 at 23:59 (CEST).

The Prize may not be subject to any change, alteration or compensation at the request of the Winner.
The Winner may refuse the Prize obtained, but under no circumstances may it be exchanged for an alternative prize, substitute or its cash value. The refusal of the prize does not give right to get any compensation.
The prize shipping is borne by the company, regardless of the country as long as it is European territory. The Prize may not be subject to any change, alteration or compensation at the request of the Winner.
6. COMPETITION MECHANICS
In order to participate in the Promotion and qualify for the Prize indicated in the PRIZE stipulation, it is necessary that the participants have acquired between the dates of the campaign (between 2601/0212/20243 and 3129/052/2024) any of the following CRUZ products at any of our online or physical points of sale in the stipulated territorial area: CRUZ Race, CRUZ Race 2023, CRUZ Race Dark, CRUZ Frame 3, CRUZ Frame 4, CRUZ Alu bike, CRUZ Criterium, CRUZ Bike Rack G, CRUZ Bike Rack N, CRUZ Pivot 2, CRUZ Pivot 3, CRUZ pivot 4, CRUZ Pivot ebike 2 bikes.

Participants must fill in all the information on the registration form (attached below) and attach the proof of purchase (ticket or invoice) https://cruz-products.com/en/module/tsregistroproducto/registro
The formats pdf, jpg or png will be valid. In any case, the information must be clear and not misleading. Any registration that does not have all the requested fields correctly completed will not be accepted.
During the registration process, a code will be automatically and randomly assigned to each Participant. This code will be stored in the CRUZBER database until the moment of the raffle. The raffle will be carried out by means of that code, obtaining a single winner.
The raffle will take place on June 1st, 2024. The Winner will be made public the same day through CRUZ's social networks and they will be contacted through the email provided in the product registration form. If, after two calendar days since the Winner has been made public, it is not possible to contact him/her by any of the provided channels, she/he will lose the right to obtain the Prize and it will be awarded to a Substitute.
CRUZBER informs the Winner that, in accordance with current applicable legislation, the Prize obtained will be considered capital gains not derived from transfers of assets, being subject to direct taxation in the Personal Income Tax - Personal income tax- and being the responsibility of the Winner to comply with their tax obligations.
CRUZBER, if required by current regulations, will carry out and bear withholding on account of Personal Income Tax -IRPF-
Likewise, CRUZBER will issue the appropriate certification that enables the Winner to comply with their tax obligations. CRUZBER will not be held responsible in any case for the incorrect tax declaration that the Prize Winner may make for this purpose
The Winner exempts CRUZBER from all responsibility for eventual delays and / or for all types of computer, transport, or logistics incidents (with an enunciative, non-limiting nature) that may occur in compliance with these Legal Bases, whether for reasons derived from a COVID-19 pandemic, force majeure, states of alarm, site, exception, or similar situations, and refuses to request any type of claim and / or compensation against CRUZBER
7. PERSONAL DATA PROCESSING
CRUZBER will process the personal data collected through this Promotion in compliance with the current law on data protection. The personal data which CRUZBER receives from voluntary Entrants will be included in an automatized file, owned by Cruzber, with address at Las Salinas Industrial Estate II, Plot 12 etc, C.P. 14960 Rute (Córdoba), registered in the corresponding Data Protection Agencies and protected with the security measures required by law.
The Entrants’ data will be used by CRUZBER with the objective of managing their participation in this Promotion (to contact the winning Entrant and award the Prize), carrying out segmentation activities for strategic and business purposes only, completing tax formalities as well as sending information and commercial offers, through ordinary and electronic means about our products and services and about other companies which belong to the group that we may consider of your interest. Unless stated otherwise, CRUZBER SAU, located Las Salinas Industrial Estate II, Plot 12 etc, C.P. 14960 Rute (Córdoba), will be responsible for the processing of your personal data. You must address CRUZBER if you wish to exercise your right to access, modify, oppose and cancel your personal data by any of the means established in the current law on data protection.
8. CONSENT FOR USE OF NAME AND ASSIGNMENT OF PUBLICITY RIGHTS
CRUZBER reserves the right to use the name and the image of the Winner in all aspects related to the development of the Promotion. Thus, the Entrants agree to the use, publication and reproduction, all over the world and without limitations, by CRUZBER, of their Image and their name in any type of publicity, promotion publication (Internet included), or any other means, with promotional or informative purposes only and when these are related to the current Promotion. There will not be any financial reward of any type for the Entrants. This agreement may be revoked at any time by the Winner, entitling CRUZBER to compensations for the damages and losses that may result.
9. MODIFICATIONS
In the event of unforeseen circumstances, CRUZBER reserves the right to make changes, cancel, shorten or extend this raffle. CRUZBER commits to give those modifications the same level of publicity as to these Legal Terms and Conditions.
10. ACCEPTING THE TERMS AND CONDITIONS
Participation in each of the promotional actions carried out by CRUZBER implies full acceptance of these general terms and conditions and the specific conditions established for each promotion. CRUZBER reserves the right to cancel the promotion for justified reasons, as well as to modify these terms and conditions or those of the promotional action at any time or to leave the prize void. Should this occur, it will be duly notified to the participants in the same channel in which the action has been carried out, with a reasoned explanation of the decision.
Likewise, CRUZBER reserves the right to exclude participants who violate the rules established in the terms and conditions or whose behaviour affects the normal development of the promotional action. CRUZBER reserves the right to disqualify those who act in an abusive or fraudulent manner. CRUZBER is exempt from liability in the event that the winner cannot be located for reasons not attributable to the company. The winner also exempts CRUZBER from liability for any damage that may arise from the use of the prize awarded.
Any incident that may arise and is not covered by these rules will be resolved by CRUZBER at its own discretion.
11. APPLICABLE LAW AND JURISDICTION
This Promotion is governed by the Spanish law. For any controversy which could result from the interpretation of this document, the parties submit to the jurisdiction of the Courts in Lucena, with express waiver to any other jurisdiction to which they might have recourse.
